On June 5, 2002, the Ninth Circuit Court of Appeals amended their decision entered on February 14, 2002 in United States v. Alpine Land & Reservoir Co. This decision represents one of many entered by the Court in the last 20 years concerning transfers within the Newlands Reclamation Project.
Under its February decision, the Ninth Circuit determined that the transfer of Rambling River Ranches should be remanded for further findings on abandonment and forfeiture. Rambling River Ranches sought a rehearing before the Ninth Circuit. The Ninth Circuit agreed that this application should be affirmed. With the amended order, Rambling River Ranches transfer applications on appeal were approved.
